Gym contract auto-renewal in Germany: how the 12-month trap actually works

A lot of people join a German gym expecting it to work like a monthly subscription they can stop whenever they want. Then, somewhere around month eleven, they discover it doesn't work that way at all, and they've just been signed up for another full year without meaning to. This is how that trap actually works, and how to avoid walking into it.

The 12-month term isn't the whole story

Most German gym contracts have a minimum term, a Laufzeit, commonly 12 or 24 months. That part is usually communicated clearly when you sign up, because it's part of the pitch: a lower monthly rate in exchange for committing to a fixed term. What's communicated far less clearly is what happens the day that term ends if you do nothing. In most cases, nothing happens automatically in your favor. The contract renews itself, often for another full term, unless you cancel it in time.

The notice period hides inside the renewal clause

The clause you actually need to find is the Kündigungsfrist, the notice period, which tells you how far before the end of your term you have to cancel. It's commonly one to three months for gym memberships, but it varies by gym and by contract. Your deadline is not the last day of your membership. It's that many months earlier. If your 12-month term ends at the end of August and your notice period is three months, your real cancel-by date is the end of May, not the end of August.

This is the part that catches people. They remember roughly when they signed up, mentally mark that date on a calendar a year out, and then miss the actual window because it closed months earlier than they assumed.

What changed with automatic renewal clauses

Since March 2022, German law limits how automatic renewal clauses (automatische Verlängerung) can be written into new consumer contracts. Broadly, a contract can no longer auto-renew you into another full fixed term of a year or more if you miss the notice window. Instead, it typically continues on a rolling basis you can cancel with one month's notice. Older contracts, or ones with terms that predate this rule, can still work differently, so check your specific contract's wording rather than assuming the newer rule automatically applies to you. If you think a gym is enforcing a renewal that doesn't match current law, the Verbraucherzentrale, Germany's consumer protection office, is the right place to check, not a guess based on a blog post.

How to actually cancel a gym membership

Some gyms, particularly larger chains with online sign-up, are required to offer a Kündigungsbutton under Section 312k of the BGB, letting you cancel directly on their website. Check for it first, since it's usually the simplest route and should give you a confirmation with the effective date.

If there's no online button, or the gym expects a written Kündigung, put it in Textform: a letter or email, not a phone call or a conversation at the front desk. State your full name, your membership or contract number, that you're canceling, the date you want it to take effect if you know it, and ask for written confirmation. Keep a copy and, if you post it, proof it was sent.

Special cases: moving, injury, price increases

German law recognizes a Sonderkündigungsrecht, a special right to cancel outside the normal notice window, in specific situations: moving somewhere too far from that specific gym location, a documented medical reason that makes it impossible for you to keep training, or the gym raising your price partway through the term. What counts as sufficient proof varies by gym and situation, so if one of these applies to you, it's worth asking the gym directly what documentation they need rather than assuming it's automatic.

The honest problem for most people isn't laziness, it's that the contract they signed a year ago is in German, was several pages long, and got filed away the same week they signed it.
